What time frame might we expect that the two tanks placed in 2011 in non-compliance to code, law and regulation, and two additional tanks placed in autumn 2013 in non-compliance be removed?



From what property lines will the setbacks be determined?



What survey (KC file # & date please) will be used to determine the various setbacks?



How far will the setbacks be and which KCC will be used to determine this?



What are the code setbacks for concrete and wooden dugouts to be in an unincorporated rural residential area from private property lines and what KCC, WAC or RCW references this?



What are the code setbacks for concrete stadium lights to be in an unincorporated rural residential area from private property lines and what KCC, WAC or RCW references this?



What are the code setbacks for power poles be in an unincorporated rural residential area from private property lines and what KCC, WAC or RCW references this?

I wanted to update you on the water tanks.  I issued this Construction Deficiency Notice, attached, to move the water tanks out of the 30 foot setback area.  Vashon Parks has already responded that they will be moving them.

Dear Mr. Meins,

 

Your name was provided as the point of contact regarding Vashon Park District fields on Vashon School District land by Mr. Bottheim.

 

I write regarding the numerous topics that are yet to be brought into law and regulation.

 

Specifically today I am addressing the removal of the water holding tanks installed without permit and in noncompliance to setbacks.  (Although in discussing setbacks that is a vague area as the survey that was presented to DDES/DPER, #20090716900007 was altered to remove information regarding our private road, previously existing survey markers, (removed by VPD again noncompliance to KCC, WAC & RCW in survey marker removal) and does not reflect "LEGAL DESCRIPTION".  Further as to todays date 25 September 2013, January 1912 & March 1947 were the last time to have lot line or borderline adjustments or alterations made and on file with KC.  Which of course another matter that must be resolved. )

 

I received a letter from the Office of the  King County Ombudsman dated 16 August 2013 that states,"DPER agrees that the temporary water tanks within the setback will need to be removed before the project can be finales, and that Parks cannot build a structure like a pump house within the setback."

 

Rather than remove the water tanks set in noncompliance, two-2 more tanks have been added!  Both clearly in noncompliance of KCC setbacks and non-permitted actions.

 

How and what is the protocol for abutting property owners to accomplish when these flagrant actions in noncompliance to KCC, WAC, RCW, DPER Permitting & law and regulation continue to take place?  

 

When you are over on Vashon some time we would enjoy meeting with you to discuss these matters.  We will even come to your new offices if necessary to have a meeting.
